Terms and conditions of sale for pre ordered equipment

 

Firstly, thank you for your purchase (or consideration of a purchase) of a pre ordered piece of equipment from us. We know you'll love the quality of the powerlifting focussed equipment we carefully procure

The below information provides you with information around your pre ordered equipment, your rights and obligations to any purchase made and our rights and obligations as a business supplying goods and services.

Our estimated time of arrivals (ETA's) are kept up to date with the latest information from our manufacturing partners. Due to the global demand of gym equipment COVID-19 has created, there have been some delays in both production and sea freight.

Please always check the product page prior to purchase to see our latest up to date ETA.

 

Acceptance

By making a purchase on a pre ordered item you irrevocably accept our terms of sale below to the fullest extent that is lawful. You acknowledge our obligations as a business and your obligations as a consumer.

 

Payment

No deposit or part-payment is available for pre ordered items. To secure your pre order, payment is in full upon checkout and at the shipping rate calculated (our shipping software generates real-time shipping rates based on your location and basket items. We make no profit on this).

 

Shipping

We ship from Malaga, Western Australia. Delivery times will be between 6-10 business days and via Toll IPEC or Toll I&S with full tracking.

 

Change of mind

We unfortunately cannot cancel a pre order for change of mind. Refunds will not be offered for a change of mind, if you found an equivalent product cheaper elsewhere, decided you did not like the purchase or had no use for it.

 

Cancellation

Cancellation of a pre order will only be granted under the most extreme of circumstances. Legally, you are bound to a purchase unless there is a major failure of a product or the product is not delivered at all.

Our terms are aligned with the legislation as outlined by the ACCC and pursuant to the Competition and Consumer Act 2010.

 

Delivery Dates

Delivery dates may be subject to delays depending on circumstances that are out of our control. Such delays may be due to the manufacturer being behind in production, the global shortage of sea containers, global port congestion and on-flow effects from the COVID19 pandemic on ports and clearance times.

 

Reasonable Delays as governed by the ACCC

COVID-19 pandemic has destabilised the global container freight supply chain, and delayed shipments and rapidly rising freight rates are putting intense pressure on Australian exporters and importers

The ACCC are currently advising that a reasonable time for a delay due to the onflow effects of COVID are much longer compared to regular trading periods.

Delays due to sea container shortages, port congestion and the onflow effects of COVID are reflected in our ETA's advertised at the time of purchase, and thankfully, sea freight journey times are stablising.

If there will be a significant delay on your order we will advise you by email.

We do our best to advise customers of any adverse delay in a pre-orders where the date of delivery.

If your order exceeds 90 days when compared to the advertsied ETA at the time of purchase we will gladly offer you the option of a refund or to change to another product for such delay.

We use the most up to date vessel information, which we update every morning, to provide you with the most accurate ETA at the time of purchase.

The ACCC advises that if a business can no longer supply the item you have purchased, they require it to be refunded. At Loaded Lifting, this is never the case as all orders come with a guarantee of delivery (subject to the delays mentioned about).
